This is the EULA for Axion, a browser-native guitar amp and effects rig operated by StreamLink Pty Ltd (ABN 64 615 965 449), an Australian company (the "Software" and the "Operator"). By using Axion, you agree to the terms below.
Operator grants you a non-exclusive, non-transferable, worldwide licence to use the Software for personal or commercial musical purposes, subject to the tier you have purchased (Free, Pro, or Cloud).
Your Pro licence is perpetual for the version of the Software you purchased and for any updates released to that version while it remains the current major release. Future major versions and Pro features released after your purchase are not automatically included. Cloud subscriptions are term-limited and run for the duration of payment.
Your perpetual Pro rights under this EULA cover your local use of the Software. They are independent of access to hosted services (the website, community gallery, magic-link sign-in, and Cloud subscription), which is governed by the Terms of Service. Suspension or termination of hosted-service access for cause does not by itself revoke your perpetual local Pro licence.
If Operator ceases to operate or shuts down the hosted version of Axion at axion.cab, our intention is that the last shipped release of the Software will remain available for download as a self-hostable package, and Pro licence holders will retain full use of the Pro features in that release.
Operator will honour this commitment where it is legally and practically feasible, excluding third-party components that cannot be redistributed (for example because of licensing changes, export or sanctions restrictions, or third-party insolvency) and excluding releases withdrawn for security or legal reasons. Where a bundled component cannot be redistributed, Operator will make reasonable efforts to provide an equivalent or to document the gap so that affected users can self-source a replacement.
Audio captured through Axion is processed locally in your browser by default. Operator does not intentionally collect, store, transmit, or analyse your audio. The only time any audio leaves your device is when you explicitly initiate an action that uploads it — for example, sharing a recording, attaching audio to a support email, or using an optional future cloud feature you have to opt into. Only the audio you choose to upload is sent, and only for as long as needed to complete the action you requested.
Recordings you create with Axion are your sole property; Operator claims no rights, no licence, and no ownership over them.
When you publish a preset to the public gallery, you grant other users a license to load, play, and remix it under the same terms (CC-BY 4.0 by default). You retain full ownership of the preset data; you can revoke a public link at any time from your account page.
Axion ships with impulse responses and NAM captures contributed by third parties under permissive licenses (CC0, CC-BY). Each is attributed in the Attributions section. Operator does not own this content; the original creators retain their rights.
Pro licenses are refundable within fourteen (14) days of purchase, no questions asked, by emailing hi@axion.cab with your license key. Cloud subscriptions can be cancelled at any time; you retain access through the end of your current billing period.
Your Pro licence is intended to last. Operator will revoke a Pro licence itself only on the following limited grounds:
Operator will give written notice of revocation via the email address on file (where one exists) and a reasonable opportunity to respond, except where prompt action is required to address fraud, an active chargeback, or active unlawful use. Revocation of a Pro licence does not by itself revoke your Free-tier rights to use the Software under §1.
Suspension or termination of hosted-service access under the Terms of Service is a separate matter and does not by itself constitute revocation of your Pro licence under this clause.
The Software is provided "as is," without warranty of any kind, express or implied. Operator does not warrant uninterrupted operation, fitness for any particular purpose, or absence of defects.
Nothing in this clause excludes, restricts, or modifies any consumer guarantees, warranties, or other rights and remedies that cannot be excluded, restricted, or modified under applicable law — including the Australian Consumer Law, UK consumer protections, and EU statutory rights.
To the maximum extent permitted by law, Operator's total liability under this agreement shall not exceed the amount you paid for the Software in the twelve (12) months preceding any claim. Operator is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, loss of revenue, business interruption, or loss of data, regardless of the form of action or the theory of liability.
Nothing in this clause limits any liability that cannot be limited under applicable law — including the Australian Consumer Law, UK consumer protections, and EU statutory rights.
This agreement is governed by the laws of the State of Victoria, Australia, without regard to conflict of laws principles. Any disputes arising under this agreement shall be resolved in the courts of Victoria, Australia, except where applicable consumer-protection law gives you the right to bring proceedings in your local courts.
Operator may update this agreement from time to time. Material changes will be notified at least thirty (30) days in advance via the email address on file for Pro and Cloud customers. Continued use after the effective date constitutes acceptance.
